There is one loophole in the FISA warrant process that no one seems to be paying attention to. This loophole has been abused numerious times by previous US Attorney Generals and provides plausible deniability for those weasels (like Clapper,and others, etc) that may be envolved with surveillance on US citizens.

The Loophole; The Attorney General may authorize emergency employment of electronic surveillance before obtaining the necessary authorization from the Foreign Intelligence Surveillance Court appointed judge. Excerpt from 50 U.S. Code § 1805 A.K.A the law of the land that covers the FISA warrant process.

e) Emergency orders

(1) Notwithstanding any other provision of this subchapter, the Attorney General may authorize the emergency employment of electronic surveillance if the Attorney General—

(A)

reasonably determines that an emergency situation exists with respect to the employment of electronic surveillance to obtain foreign intelligence information before an order authorizing such surveillance can with due diligence be obtained;

(B)

reasonably determines that the factual basis for the issuance of an order under this subchapter to approve such electronic surveillance exists;

(C)

informs, either personally or through a designee, a judge having jurisdiction under section 1803 of this title at the time of such authorization that the decision has been made to employ emergency electronic surveillance; and

(D)

makes an application in accordance with this subchapter to a judge having jurisdiction under section 1803 of this title as soon as practicable, but not later than 7 days after the Attorney General authorizes such surveillance.

(2)

If the Attorney General authorizes the emergency employment of electronic surveillance under paragraph (1), the Attorney General shall require that the minimization procedures required by this subchapter for the issuance of a judicial order be followed.

(3)

In the absence of a judicial order approving such electronic surveillance, the surveillance shall terminate when the information sought is obtained, when the application for the order is denied, or after the expiration of 7 days from the time of authorization by the Attorney General, whichever is earliest.

(4)

A denial of the application made under this subsection may be reviewed as provided in section 1803 of this title.

(5)

In the event that such application for approval is denied, or in any other case where the electronic surveillance is terminated and no order is issued approving the surveillance, no information obtained or evidence derived from such surveillance shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof, and no information concerning any United States person acquired from such surveillance shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of such person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.

I haven't read too much on this yet. I can think of a couple of legitimate reasons that a court may have approved a tap / monitoring; I can also completely believe that the vast majority of Trump supporters would not care if the reasoning was justified & legal or not. Absent specifics on what the President based his statement (via Twitter), really impossibe to tell what he could be referring to.

I think It's about time for Melania to "coincidentally" run into the AG on the Phoenix Tarmac to discuss the grandkids, her golf-game and a FISA Warrant to surveil the Obama/Valerie Jarrett DC residence.

I can think of a couple of legitimate reasons that a court may have approved a tap / monitoring; I can also completely believe that the vast majority of Trump supporters would not care if the reasoning was justified & legal or not. Absent specifics on what the President based his statement (via Twitter), really impossibe to tell what he could be referring to.

Who's to say if there is wire tapping of trump being done, it's being done legally with a FISA warrant.. You gotta admit, with the # of leaks we keep seeing, that it is a POSSIBILITY that those leaks are causes someone in the WH is being tapped.

also, since Obama did tap a # of reporters, even having one's laptop hacked into during his admin, its NOT beyond reason to see him getting Trump tapped..

I searched that and it doesn't seem so clear cut that Sharyl Attkisson's laptop was hacked. She's the one who said that in a book and cites "security experts" yet none of them would respond when contacted by the media. Her description of what happened many experts stated that it sounded like just normal technical glitches with her computer and basic malware that anyone could get on their laptop. She very well could have just gone to a website or clicked on a link that installed the malware. Everyone has had their computer get a virus on it at some point I'm sure.

I haven't found any articles other than blogs that state phones were hacked. One article quotes James Rosen as saying no he was not 'tapped.' He even stated that he was investigated because he got classified material from a source in the State Department in 2010. They didn't charge him they investigated him because he had received that information from that person who was charged with espionage.
