Lt. Cmdr. Syneeda Penland was convicted of adultery and conduct unbecoming, and was forced out of the Navy months shy of her retirement. But Penland swears she was victimized by her command for reporting waste and fraud.

Now, Penland will have a second chance to prove whether she was the victim of whistleblower retaliation by leaders at Navy Expeditionary Combat Command in the 6-year-old case.

A federal judge on April 20 ruled that the Board for Correction of Naval Records must take a second look at Penland's case to determine whether her substantiated claims of waste, fraud and abuse against her command confer whistleblower status, as she claims — and if they do, whether the Navy should compensate her for forcing her out months before her 20-year retirement mark because of a felony conviction.

This article / situation is actually very interesting. I have read the FOIA released versions of her initial US FltForces IG Complaint, Navy IG Reprisal Claim, DoD IG Whistleblower Reprisal Claim and also her charge sheet and the transcript from her Court Martial. A basic timeline of what happened:

1. LCDR Penland (O4) was in a relationship with LTjg Wiggan (O2), LTjg Wiggan was prior enlisted and married to an E6.
2. LCDR Penland was communicating with the E6, the E6 obtained a military protective order, the LCDR continued and the E6 reported the harassment & adultery to the LCDR's command. At one point LCDR Penland sent photos of the LTjg genitalia to the E6.
3. LCDR Penland was charged with violating a lawful order (the protective order) and adultery and offered Captain's Mast (NJP).
4. After LCDR Penland was charged with adultery, she filed an IG complaint against her command IRT contract and financial issues. The complaint contained 27 or 28 complaints.
5. LCDR Penland refuses Captain's Mast (NJP), and the case is referred to a Court Martial.
6. LCDR Penland is convicted at Court Martial and sentenced to the brig, a $9,000 fine and a show cause board dismisses her from the Navy at about the 19 1/2 year mark, just short of qualifying for her retirement.

Former LCDR Penland has sued the Navy several times over the last few years, claining she was discriminated against (she is a black female), that the LTjg was never punished, that she was wrongfully convicted (did not commit adultery) etc. She has done a decent job of waging a campaign on the internet & social media about her case, she fails to accurately address a couple of things that the Navy Times article also misses:

1. The LTjg was never punished: False. The LTjg accepted Captain's Mast (NJP), failed to promote to LT (O3) and retired from the Navy.

2. She was wrongfully convicted / did not commit adultery: False. Her story changed several times. She claimed (& still claims publically) that the photos of the male's genitalia were not the LTjg but another man;


The investigation into her relationship with then-Lt. j.g. Mark Wiggan began in April 2007, based on sexual photos of her with a man. She claims those photos are of an ex-boyfriend, not her friend and coworker.

however in one of her suits against the Navy LCDR Penland intimated that the photos were of LTjg Wiggan (footnote 1, pg 2 http://www.sailorbob.com/files/foia/penland/Penland%20vs%20Mabus%202015.pdf ).

3. She did not violate the military protective order: False. She denied harassing the E6, even though records from her Gov't issued cell phone showed dozens of calls to the E6's personal cell -- after the military protective order was issued. She also went aboard the E6's ship and caused a scene with the XO.


There are two distinct issues in this situation that former LCDR Penland has morphed into one:

1. She committed adultery, disobeyed a lawful order, used her position as a LCDR to intimidate and harass a junior Sailor (the wife of the man she was sleeping with).

2. The IG complaint, which was initiated by LCDR Penland. 2 of the complaints were substantiated.

It appears that the IG complaint may have been an attempt to deflect accountability and 'blame the accuser). The IG complaint was filed after she was charged with adultery and disobeying a lawful order. Also, if she was truly innocent of the adultery I agree she should have denied the NJP and let the case go to Court Martial; however she wasn't innocent. The LTjg cooperated with the prosecution. She changed her story from "I did not commit adultery", to "Those photos are of another man", to "I thought he was divorced" to "I knew he was married since I knew exactly how to get a hold of and locate his wife". In a subsequent lawsuit (after the Court Martial) she admitted she was having an affair with him.

She chose the Court Martial which carries a higher burden of proof, but also higher potential punishments. Now, 7 years later she is still carrying on the campaign to clear her name and recover her retirement. In the case of the substantiated IG complaints, corrective action was taken. In the case of her adultery, conduct, and harassment of the junior Sailor, I think the Navy did the right thing ... she did not conduct herself honorably and they took action. She chose to decline the NJP (which could have punished her but allowed her to keep her retirement) she did not and now has to deal with those consequences.

Sounds like a professional victim here. Surprised she didn't claim to be raped too. If anyone was doing the reprisal, it was her. Why even contact the mans wife?

LOL, I know her. AND the dude she was cheating with. She was DISBO onboard the USS Stout (DDG 55) as a LT, and LTJG Wiggan was a Chief. If I remember correctly, he was a GSMC. LOL, I didn't know anything was going on between the two!

None of this surprises me, be honest. She always shady as fuck.

None of this surprises me, be honest. She always shady as fuck.

Funny. I only know of her, she was a CTA when she was enlisted and I knew some people who had served with her had the same impression (shady) and also that she seemed to always be surrounded by drama.

I have read that a big part of her fight is that she has recently had some medical issues, and the pension and medical benefits would help her. A sad situation, but she really made the bed she now lies in.

Lemme take that back - she wasn't the DISBO, she was the SUPPO. However, she spent the majority of her time in the disbursing office. As a PN2 at the time, I had to deal with her far more often than I should have (which is never).
